      April Member & Guest Promotion Terms and Conditions of Entry

      1 Competition

      1.1  These terms and conditions apply to the CityFitness Member & Guest Promotion. (Competition).

      1.2 The Competition involves three eligible CityFitness members across all CityFitness clubs being randomly selected to win one of three $2,000 Prezzy® Cards (Prize Draw). Further details of the Prize Draw and eligibility for the Competition are set out below.
      1.3 By entering the Competition, you confirm that you have read and agreed terms and conditions (Terms).

      2 Promoter

      2.1 The competition is conducted by CityFitness Group Limited (Promoter).

      3 Competition Period

      3.1 The Competition starts at 2pm on 4 April 2025 and ends at 11:59pm on 30 April 2025 (Promotional Period).

      4 Eligibility Criteria

      4.1 To enter the competition an entrant must be a New Zealand resident and at least 18 years of age at the time of entry.

      4.2 Unless you notify the Promoter that you do not want to be entered into the Competition, you will be eligible and automatically entered into the Competition by the Promoter:

       (a)     Existing members:
        • you hold a current Black Card or Premium membership (not set for cancellation) at any CityFitness club in New Zealand, and you are up to date with your membership payments;
        • at any time during the Promotional Period, you validly sign in a guest who is not a current CityFitness member;
        • any guest(s) signed in by you then subsequently sign up as a member at any CityFitness club (using the same email address they signed in as a guest with) before the end of the Promotional Period; and
        • at the end of the Promotional Period, your guest’s membership is still active (i.e. not set for cancellation) and the guest is up to date with their membership payments; and
        • you are not ineligible under clause 3; or
            (b)     New members:
        • you were signed in as a guest of a current Black Card or Premium membership holder during the Promotional Period;
        • you then subsequently sign up as a member at any CityFitness club (using the same email address they signed in as a guest with) before the end of the Promotional Period;
        • at the end of the Promotional Period, your membership is still active (i.e. not set for cancellation) and is up to date with membership payments;
        • you are not ineligible under clause 3; or

        5 Prize

        5.1 The prize is one of three Prezzy® Cards valued at $2,000 (each a Prize). Eligible participants will be entitled to receive a maximum of one Prezzy® Card.

        5.2 Use of the Prize is subject to the Prezzy® Card terms and conditions, including expiry rules. More information about Prezzy® Cards’ terms and conditions can be found at www.prezzycard.co.nz.

        5.3 The Prize cannot be redeemed for cash and cannot be transferred or exchanged.

        5.4 If, for any reason, the Prize is or becomes unavailable, the Promoter may, at its sole discretion, substitute an alternative prize of a value that is no less than the value of the Prize.

        6 The Prize Draw

        6.1 The Prize Draw will be conducted after the end of the Promotional Period at the Promoter’s premises.

        6.2 Three winners will be drawn at random from all eligible entrants across all CityFitness clubs entered into the Competition.

        6.3 The Promoter will notify the three winners by email within two weeks of the end of the Promotional Period, which will contain instructions on how the winner must claim the Prize.

        6.4 The winner agrees that they will participate in all reasonable promotional activities in relation to the Competition, as requested by the Promoter.

        7 Redraws

        7.1 If a Prize is not claimed within one month after the Prize Draw, the same winner is drawn more than once, or the Promoter determines that a winner is not eligible, the winner forfeits the Prize (or additional Prize, as the case may be) and a replacement winner will be redrawn from the remaining pool of entries from the Prize Draw. The redraw will take place no earlier than one month and one day after the original Prize Draw.

        7.2 The winner of the redraw will be notified by email within two days of the redraw.

         

        8 Discontinuance of the Competition and disqualification of an entrant

        8.1 The Promoter reserves the right to discontinue the Competition at any time and, in its sole and absolute discretion, may cancel, suspend, terminate or modify these Terms or the Competition without liability and without the need to provide compensation to entrants or attempted entrants.

        8.2 The Promoter reserves the right (in its sole and absolute discretion) to:

           (a) Require a winner to provide proof of identity, eligibility and any other relevant               details to a standard satisfactory to the Promoter; and
           (b) Disqualify any entrant who fails to provide such information, submits an entry               that is not in accordance with these Terms, or who has (or the Promoter                         reasonably suspects has) been misleading or fraudulent in the course of the                 Competition.

         

        9 Privacy
        9.1 In accordance with the Privacy Act 2020, the Promoter notifies entrants that entry in this Competition involves the collection of personal information about entrants (which may include their name, address, phone number, email address and image). This is collected for the purposes of establishing eligibility, carrying out the Competition, promoting the Competition and the winner and, as necessary, identity verification and assessing compliance with these terms and the law. If the requested information is not provided, the entrant will not be eligible to participate in the Competition.

        9.2 The Promoter may disclose an entrant’s personal information to its personnel, representatives, other parties involved in administering the Competition, and any regulatory authorities (as required).

        9.3 By entering the Competition, each entrant consents to:

           (a) The Promoter’s privacy policy, which is available on the Promoter’s website at           https://help.cityfitness.co.nz/terms-conditions-privacy-accessibility-policy; and
           (b) Receiving commercial electronic messages (including email messages) from            the Promoter throughout the duration of the Competition and subsequently until          such time as the entrant notifies the Promoter that he or she no longer wishes to         receive such messages.

        9.4 It is the entrant’s responsibility to notify the Promoter if their contact details change during the period of the Competition. A request to access or modify any information should be directed to the Promoter at member.services@cityfitness.co.nz.

        10 General

        10.1 Decisions of the Promoter regarding the Competition are final and each entrant agrees to be bound by any such decisions.

        10.2 The Promoter takes no responsibility for any failure to enter an eligible entrant into the Prize Draw, or for any late, lost, incomplete, incorrectly submitted or ineligible entries.

        10.3 To the extent permitted by law, the Promoter is not liable to any person (including any entrant) for any loss or damage suffered or sustained by any person (including, but not limited to, direct, indirect, consequential or economic loss) in connection with the Competition or the Prize.

        10.4 These Terms are governed by the laws of New Zealand
